2. Definitions

  • "We", "Us", "Our" refers to Wartens Ltd trading as PartsHIRE.
  • "You", "Your" refers to the customer purchasing products from our website.
  • "Products" refers to all goods available for purchase on our website.
  • "Contract" refers to the legally binding agreement formed when we accept your order.

3. Ordering Process

In accordance with the Electronic Commerce (EC Directive) Regulations 2002:

  • Placing an order on our website constitutes an offer to purchase. A contract is not formed until we send you an order confirmation email.
  • We reserve the right to refuse or cancel any order for any reason, including product unavailability, pricing errors, or suspected fraud.
  • You are responsible for ensuring all information provided during the ordering process is accurate and complete.
  • You will have the opportunity to review and correct your order before submitting it.
  • Order confirmations will be sent via email and will include full details of your order, the total price, and estimated delivery timeframes.

4. Pricing and Payment

  • All prices on our website are displayed in British Pounds Sterling (GBP) and are exclusive of VAT unless otherwise stated.
  • VAT will be added at the applicable rate at checkout for UK customers. VAT-registered businesses may be eligible for VAT exemption on qualifying orders.
  • We make every effort to ensure pricing is accurate. In the event of a pricing error, we will contact you before processing your order to confirm whether you wish to proceed at the correct price.
  • Payment is processed securely via Stripe. We accept major credit and debit cards.

5. Delivery

We currently deliver to UK mainland addresses only. Delivery to Scottish Highlands, Northern Ireland, Isle of Man, Channel Islands, and other offshore locations may be subject to additional charges and longer delivery times.

Full delivery terms, timeframes, and costs are set out in our Delivery Policy. Risk in the products passes to you upon delivery. Title to the products shall not pass to you until we have received payment in full.

6. Right to Cancel (Cooling-Off Period)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer, you have the right to cancel your order within 14 days from the date you receive the goods, without giving any reason.

To exercise your right to cancel, you must notify us of your decision by a clear statement (for example, by email or phone). You must then return the goods to us within 14 days of notifying us of your cancellation.

7. Returns and Refunds

Goods must be returned in their original condition and packaging. You are responsible for the cost of returning the goods unless they are faulty or not as described. 8. Consumer Rights and Warranty

Under the Consumer Rights Act 2015, all products must be of satisfactory quality, fit for purpose, and as described. If a product does not meet these requirements:

  • Within 30 days: You are entitled to a full refund if the product is faulty or not as described.
  • After 30 days but within 6 months: We will attempt to repair or replace the product. If this is not possible, you are entitled to a full refund.
  • After 6 months: You must demonstrate the product was faulty at the time of delivery.

We offer a 30-day warranty on all products from the date of delivery. This warranty covers manufacturing defects and does not cover damage caused by misuse, improper installation, or normal wear and tear.

9. Limitation of Liability

Nothing in these Terms shall exclude or limit our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any matter for which it would be unlawful for us to exclude or limit our liability

Subject to the above, our total liability to you in connection with any order shall not exceed the total price paid by you for that order. We shall not be liable for any indirect, incidental, special, or consequential losses, including loss of profits, loss of business, or loss of data.

All content on this website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of Wartens Ltd or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

11. Acceptable Use

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the website or its systems
  • Use automated tools to scrape, mine, or extract data from the website
  • Interfere with or disrupt the website or servers connected to it
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, strikes, supply chain disruptions, or failure of telecommunications networks.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
